Warning, Border Confiscation, Argentina (Planung)

andeanroads ⌂ @, Montag, 21. April 2014, 15:20 (vor 3650 Tagen)

I heard this morning from someone that got his camper seized by the Argentinean customs in Patagonia because the vehicle was not registered in his name and he had not come into Argentina with it. He has a notarized permit from the previous owner, but it is not legal for a foreigner to buy a vehicle from another foreigner in Argentina. Just a heads up, beware!

I have a car 'sold' to me this way in Ushuaia. Right now i've got it in Buenos Aires. When i tried to take it on the ferry to Uruguay i was told i couldn't because the customs form's listing of who drove it in to the country didn't match my name. They told me they COULD seize the car but didn't seem to indicate that i was in any danger. I was told to go back to the main customs office in Buenos Aires and try and resolve the problem.

The problem with this in argentina is apparently the person who brings the car in to argentina must either leave with it or go to a customs office and request permission for the new driver 'owner' to leave the country with it.

I haven't resolved my problem yet, but it's sobering to read somebody had their camper seized.

That's why everybody "sells" their cars between borders, no? Simply leave the country, hand over the money and the new owner enters with the new papers.

Also I'd be very wary about these "I've heard" stories, there is too much of them around.

I am the previous owner. And we went togther to the Lawyer and to the customs in BUenos aires and Talked to the Woman who made all the papaerworks there..THe gave the people permisions to drive in Argentina in the temporal Import Papers. So they traveled some weeks in Argetina and the in CHile when they try to reenter argetina they took the van away.... There where a lot of other traveler who made the same process like us .SO it has nothing to do that we didnt made the border together and then reenter...

I think this was just a missunderstanding at the border or a chance to make a bribe attemt.... Why can they take the American VAn away when trying to enter the Country .. the can just forbit it to enter the COuntry but not take a forgeing Van Away...

I am totaly puzzelt what happen there ...

I believe that the problem is that the car is not registered in their name, but I don't know if this was actually the case. Legally, if you come in with a foreign vehicle to Argentina it needs to leave with you. Leaving the country without the vehicle and coming back to get it is another matter, which works quite well by the way. But as far as the vehicle, I would venture to say that the problem was that they tried to exit Argentina with a car that had entered under someone else's name. I don't know the details, this is just a guess about what happened. Confiscating the car seems a little extreme, they should have send them back to fix the issue...

The Van get confiscated when they tried to reenter to argentina.. Thats rediculous !!!

I guess they gave the Impotacion Temporal Paper away when they left Argentina. and where they names where in that gave them permission (on the Right side)

When they reenter they showed the Selling contract to the Border , and then the coustom said that this was illegal.... That forgeiner are not allowed to sell Van to other Froeigners... so they took the van away...

They didnt care about the Papers from the Attorney wich gave them Permission to drive and cross Borders...

I thing what the border did was not correct !!! and the Problem was that they didnt speak a Word spanish and the border people not a word English....

The US guys get scared and left argetina within 3 Days without the Van... and without waiting for a solution...

So i am still the owner and the Van is in Argetina and i am in Germany...

"I guess they gave the Impotacion Temporal Paper away when they left Argentina. and where they names where in that gave them permission (on the Right side) "

This is the problem - because you can't NOT give that TIP away when you leave simply because you must hand it in when you leave the country. Then what do you do. No legal right to drive that vehicle into the next country.

Much misunderstanding of the process here. Being an authorised driver on the TIP ie your name in the RHS of the TIP, ONLY gives you the right to drive that vehicle IN ARGENTINA. It may allow you to even drive it out of Argentina but then you are left in-between border posts with no legal right to be in control of that car. No title or registration papers in your name and no legal permission either. If you do have a new title and registration in your name then that could be used to enter the next country

If you have a Power of Attorney (Poder) then you have a chance but without it, you are stuck.

The van in question had already been across the border three times without problems and it was the 4th time that they ran into strife.

Another possible cause of similar problems is when you cross an isolated border with no full-time computer hookup and they don't get around to entering the cancelled TIP into the national system.

Previous owner of my vehicle got held up at one entry into Argentina because there were three of four live TIPs still showing on the database, one of them going back 3 years. In that time he had crossed back and forth probably ten times and it was only on the last crossing that they spotted it. They did let him in provided he called in at the head office of customs and sorted it all out. They went back through passports of both passengers to determine that they had done the right thing and it was all OK in the end but it cost them a major detour and a couple of wasted days.

His suggestion was to get a copy of the TIP each time and ask the customs officer to stamp the copy on departure each time so there is some sort of paper trail apart from the computer record.

(we nearly had problems because my passport wasn't stamped at a previous crossing but luckily Betty's was so the officer accepted that the immigration officer was at fault. Guess we have to make sure that the professionals do their job)

Klingt total unhoeflich. Auserdem ziemlich nationalistisch.

Up until now, I have had the best impression of absolutely every German I have met, in real life or virtually. But I see that, just like us in Argentina, you also have assholes over there...

The recent topic on Drive the Americas forum is also relevant to this topic

http://www.drivetheamericas.com/forums/car-kidnapped-argentine-customs

"...
Last month i tried to take the car via Buquebus on the ferry to Uruguay and was told that there was a problem because the customs form didn't list my name, and that we'd have to go to central customs to resolve it. I did try and find central customs but couldn't find the adress and figured that the customs lady was just being extra picky since my father in law had crossed the border with the same papers without a problem.

So we drove up this morning to the Gualeguaychu border figuring a smaller border might do the same thing has happened in with my father in law, and just let us through. Well nope. They decided to seize the car, sequestrar (kidnap) is the word they used. Claiming that the customs form requires the person to leave with the car who enters with it.
